BACKGROUND On March 17, 2015, Applicants submitted a Joint Abbreviated Application for a certificate of public convenience and necessity authorizing the construction and operation of facilities comprising their Northern Access 2016 Project, and for the requisite authorization to abandon certain related facilities (the Application). As part of the Application, Empire requested authorization to, among other things, construct and -2- 2. Empire (a) Pendleton Compressor Station (i) Location In the Application, Empire proposed to construct the Pendleton Compressor Station on a parcel adjacent to National Fuels existing Line XM-10 pipeline, off Aiken Road, in Pendleton, New York (the Aiken Road Site). As a result of an impasse between Empire and the landowner concerning the purchase of the Aiken Road Site, and concerns raised by community stakeholders as to the construction of the Pendleton Compressor Station at the Aiken Road Site, Empire committed to pursuing further alternative locations. On August 31, 2015, Empire secured an option to purchase an approximately 20-acre industrially-zoned parcel on Killian Road, in the Town of Pendleton, New York. Empire submits that the Killian Road Site is preferred from an environmental standpoint and also addresses various stakeholders concerns regarding the Aiken Road Site. As such, by way of this Amendment, Empire is formally revising its preferred Pendleton Compressor Station site from the Aiken Road Site to the Killian Road Site.
