COMPLAINT OF CITGO PETROLEUM CORPORATION AGAINST ENTERPRISE TE PRODUCTS PIPELINE COMPANY LLC I. INTRODUCTION 1. CITGO Petroleum Corporation (CITGO) hereby submits this Complaint against Enterprise TE Products Pipeline Company LLC (Enterprise TEPPCO) pursuant to Rule 206 of the Rules of Practice and Procedure of the Federal Energy Regulatory Commission (Commission or FERC), 18 C.F.R. 385.206 (2013); Sections 343.1 and 343.2 of the Rules Applicable to Oil Pipeline Proceedings, 18 C.F.R. 343.1 and 343.2 (2013); and Sections 1(4), 1(6), 8, 13(1), 15(1) and 16(1) of the Interstate Commerce Act (ICA), 49 U.S.C. 1(4), 1(6), 8, 13(1), 15(1), and 16(1) (1984). 2. CITGO challenges the lawfulness of Enterprise TEPPCOs FERC Tariff No. 55.28.0, which cancelled transportation services for certain distillates and jet fuel, including Ultra-Low Sulphur Diesel (ULSD) fuel. In particular, CITGO alleges that Enterprise TEPPCOs termination of service for ULSD violated a settlement agreement (hereinafter, Settlement Agreement) executed by CITGO and Enterprise TEPPCO and approved by the Commission in Enterprise TE Products Pipeline Company LLC, Docket No. IS12-203-000. See Enterprise TE Products Pipeline Co., LLC, 143 FERC 61,197 (2013). CITGO seeks reparations and damages for the losses it has incurred as a result of Enterprise TEPPCOs termination of service for ULSD, and such other and further relief available and appropriate under the ICA and the Commissions rules and regulations. 3. CITGO further respectfully requests that the Commission consolidate this complaint into the pending consolidated proceedings in Docket Nos. OR13-25-000 and OR13- 26-000. This complaint arises in connection with the same Enterprise TEPPCO tariffs and Settlement Agreement at issue in the pending consolidated actions in Docket Nos. OR13-25-000 and OR13-26-000 and raises the identical liability issues determined in the Commissions October 17, 2013 Order. See CHS et al. v. Enterprise TE Products Pipeline Co. LLC, 145 FERC 61,056 (2013)(finding Enterprise TEPPCO liable for breach of the Settlement Agreement, consolidating the complaints and establishing a limited hearing on damages). 1 II.
